These Terms & Conditions (“Terms”) govern the use of the ZK Motorsports website, and all services, products, and parts provided by ZK Motorsports (“we”, “our”, “us”). By accessing our website, purchasing products, or engaging our services, you acknowledge and agree to be bound by these Terms.
ZK Motorsports reserves the right to amend or update these Terms at any time without prior notice. Continued use of the website or services constitutes acceptance of any revised Terms.
2. Services
ZK Motorsports provides high-performance automotive services including, but not limited to, engine tuning, diagnostics, racecar building, vehicle modifications, and performance part installations. All services are subject to vehicle inspection, technical suitability, and availability.
Service outcomes may vary depending on vehicle condition, maintenance history, fuel quality, environmental conditions, and usage.
3. Performance Disclaimer
All performance figures, estimates, or results referenced on the website, social media platforms, or during consultations are indicative only. ZK Motorsports does not guarantee specific horsepower, torque or performance results.
Performance tuning and modifications may increase stress on vehicle components. The customer acknowledges and accepts all associated risks.
4. Vehicle Condition & Customer Responsibility
By engaging our services or purchasing parts, the customer confirms that all relevant information has been disclosed, including prior modifications, mechanical faults, accidents, or abnormal behavior.
ZK Motorsports shall not be held responsible for failures or damages arising from pre-existing conditions or undisclosed issues.
5. Motorsport & Road Use Disclaimer
Certain services, software, or vehicle modifications may be intended for off-road, track, or motorsport use only. It is the customer’s responsibility to ensure that their vehicle complies with road regulations, registration requirements, and inspection standards applicable in their jurisdiction.
ZK Motorsports shall not be liable for fines, penalties, registration issues, or legal consequences arising from vehicle modifications.
6. Limitation of Liability
To the maximum extent permitted by law, ZK Motorsports shall not be liable for any indirect, incidental, or consequential damages, including loss of use, loss of profit, or loss of opportunity.
Any liability, if established, shall be limited strictly to the value of the service or product provided.
7. Parts, Manufacturing Defects & Supplier Warranty
All parts supplied or sold by ZK Motorsports are sourced from third-party manufacturers and suppliers.
In the event of a suspected manufacturing defect, customers must contact sales@zkmotorsports.com and provide full details of the issue, including clear photos and/or videos of the affected part. All claims are subject to inspection by ZK Motorsports and coordination with the relevant supplier or manufacturer.
Following this process, the customer will be informed of the outcome. Replacement, repair, or credit is not guaranteed and is subject solely to the supplier’s or manufacturer’s decision. ZK Motorsports shall not be held responsible for outcomes determined by third-party suppliers.
8. Returns, Compatibility & Responsibility
All parts purchased through the ZK Motorsports website are non-returnable and non-refundable, unless a clear and verified manufacturing defect is confirmed in accordance with our defect inspection process.
Each product displayed on our website includes a WhatsApp contact link, allowing customers to communicate directly with a ZK Motorsports expert to confirm compatibility prior to purchase. Customers are strongly advised to use this service and provide complete and accurate vehicle details, including make, model, year, engine specifications, and existing modifications.
ZK Motorsports shall not be responsible for parts that do not fit, match, or suit a vehicle if incorrect, incomplete, or undisclosed information was provided by the customer at the time of inquiry or purchase.
9. Bookings, Deposits & Payments
Deposits may be required to confirm service bookings or to order parts. Deposits are non-refundable once work has commenced or parts have been ordered.
For special-order parts, a 50% advance payment is required before the order can be processed.
Full payment must be completed before vehicle or parts release. ZK Motorsports reserves the right to retain vehicles or products until all outstanding balances are settled.
Customers are requested to retrieve their vehicles within 24 hours following service completion. Vehicles not collected within this timeframe will incur a daily parking/storage fee of AED 50, calculated from the end of the 24-hour period.
10. Cancellations & Delays
Cancellations must be communicated in advance. Delays may occur due to parts availability, supplier lead times, technical complexity, or unforeseen circumstances. ZK Motorsports shall not be liable for delays beyond its reasonable control.
11. Intellectual Property
All website content, including text, images, videos, logos, and branding, is the intellectual property of ZK Motorsports. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.
12. Media & Marketing Consent
Unless otherwise requested in writing, customers grant ZK Motorsports permission to photograph or record vehicles and related content for use in marketing, social media, and promotional materials.
13. Website Use
Users agree not to misuse the website, attempt unauthorized access, submit false information, or engage in any activity that may disrupt or harm the website or business operations.
14. Privacy
Personal information collected through the website or during service engagement is handled in accordance with our Privacy Policy and applicable UAE data protection laws.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the UAE courts.
16. Force Majeure
ZK Motorsports shall not be held responsible for any failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, supply chain disruptions, governmental actions, or force majeure events.
